Road, footpath and carpark occupancy permit
Applying for a permit – before you begin
The Road, Footpath and Carpark Occupancy Permit is issued under Section 138 of the Roads Act 1993 and Section 68 of the Local Government Act 1993. The application addresses the following types of occupation:
- Occupation of an area of road, footpath or carpark directly or indirectly associated with works or an activity,
- Occupation of the footpath to provide access to maintain an adjacent building, or
- Occupation of a large area, such as a street block or public carpark, for the carrying out of an activity and event.
Where the occupation is for activities and events (Type 3), there may be other approvals that need to obtained before an Occupancy Permit can be issued, such as:
- If you wish to undertake an activity on community land such as public entertainment, you will need to apply for a building certificate under Section 68 of the Local Government Act. You should contact Council’s Building Certification team if you are unsure whether an application is required.
- Some events will require the lodgement of a development application. You should contact one of Council’s Duty Planners if you are unsure whether a development application is required.
- Where the activity or event requires the full (temporary) closure of a section of road, a Temporary Full Road Closure application will also be required. You should contact Council’s Traffic Section to discuss the proposal, understand likely requirements, timeframes involved and if the road closure can be supported.
Fees and charges
The application fee and calculated monthly fee is payable upon lodgement. Council will advise you of any additional fees after assessment of the application and payment will be required prior to approval of the Permit.
Note if you have a road occupation: If a full temporary road closure is proposed – a Road Closure and Work Zone Permit Application must be submitted instead. These matters needs to be reported to the Local Traffic Committee and as such will take at least ten (10) weeks to process.
Note: The minimum weekly fee covers an area up to 10.0m². If the area exceeds 10.0m², the weekly fee is $13.80 × total m².

Note C: Use of road, footpath, Council car park for the purpose of providing short term community services such as blood bank, breast screening, etc, or events deemed to have significant local or community benefit are exempt from fees, subject to approval.

Questions you will need to answer during online lodgement
You will need to provide the following information in support of your application:
- Address of associated property
- Details of related development approval, if applicable (i.e. development consent, complying development certificate)
- Details of the associated activity – location and summary of works/activity
- Details of the proposed occupation – dimensions, area, duration and start/finish dates
- Expiry date of public liability insurance cover
- Type of occupation:
- Occupy road, footpath or public car park
- Occupy footpath for minor building maintenance work, e.g. mobile scaffolding, a ladder and window cleaning equipment
- Commercial/special event
- If a commercial/special event, are you seeking a fee exemption as described in the Application and Permit conditions?

Mandatory supporting documents
Please ensure you have the following documents ready before commencing your online application. These documents will need to be uploaded with the application during lodgement.
- Application form – a signed copy of the application form.
- Public Liability Insurance Certificate of Currency – required for every application (see details above)
- A traffic control plan (prepared by an RMS accredited person) in compliance with RMS Traffic Control at Work Sites Manual Guidelines – AS1742.3 and Work Cover NSW regulations
- Scope of works/site plan
- A draft notification letter(s) for distribution by the applicant to residents in the affected area, for approval by Council.
If you are on or near a state road or traffic lights
If the works are to be carried out on or near a Transport for NSW state classified road or traffic lights, you will need to demonstrate that you have obtained written consent from Transport for NSW.

How to apply for your permit
Once you've completed the application form and collected all mandatory supporting documents, you use our online self-service website to lodge the application.
